The
National Association of Wheat Growers (NAWG) is requesting support from Members
of Congress for H.R. 935, the Reducing Regulatory Burdens
Act, according to a news release available here. The Wisconsin Ag Connection also
published the news release available here.
The bill
would eliminate the need for a Clean Water Act National Pollution Discharge
Elimination System (NPDES) permit when applying pesticides.
Certain
pesticide applications require an NPDES permit, in addition to regulation
through Federal Insecticide, Fungicide, and Rodenticide Act, because of a 2009
court decision in National Cotton Council v. EPA.
Pesticides
are applied based on label rates in accordance with the law. Additional
environmental protections do not result from the NPDES permit, only paperwork
and possible citizen lawsuits and fines up to $37,500 per day.

National Agricultural Law Center’s website here.
