Equal Access to Justice Act applies to NAD

The United States Court of Appeals for the Seventh Circuit recently held in Five Points Road Joint Venture v. Johannas, 542 F.3d 1121 (7th Cir. 2008) that the Equal Access to Justice Act applies to decisions issued by the USDA National Appeals Division.
