Judge's Ruling: Poultry Litter Can be Solid Waste

The Arkansas Democrat Gazette is reporting that U.S. District Judge Gregory K. Frizzell has ruled that poultry litter can be considered a solid waste under federal environmental laws.

The ruling is considered a victory for Oklahoma in the ongoing legal battle between the state and twelve Arkansas Poultry companies. Attorneys for the companies had argued against the litter being classified as solid waste because it has market value as a fertilizer.

Judge Frizzell acknowledged that it remains a "gray issue," but ruled that poultry litter can be considered a solid waste to the extent that is it over-applied in some instances.
