The EIS was prepared after a 2007 by the U.S. District Court for the Northern District of California that AHPIS had violated NEPA by deregulating the genetically engineered alfalfa without performing an environmental assessment. The court also issued a preliminary injunction by making Roundup Ready alfalfa a regulated article.
