Parties Agree to No Jury Trial in Poultry Litigation


Some may remember back a few weeks ago, Oklahoma won a victory to have it’s remaining claims in the on-going poultry litigation heard by a jury. That all changed yesterday. On Wednesday, attorneys for Oklahoma and the Arkansas poultry companies agreed there was no need for a jury trial. This leaves the decision up to U.S. District Judge Greg Frizzell to rule on the case.

This moves comes after Judge Frizzell limited the jury to only sit through testimony on the issue of a state law claim that the poultry companies polluted the Illinois River watershed. According to the story by the Arkansas Democrat-Gazette, “[t]he two sides told Frizzell about their agreement Wednesday morning. Louis Bullock, a private attorney for Oklahoma, approached poultry company attorneys before court started Wednesday, saying the state no longer wants a jury trial.”

The trial is now scheduled to begin next Thursday, September 24 in Tulsa Oklahoma.
